Are Your COVID-19 Emergency Rules Expired?

Pursuant to California Civil Code, emergency rules expire after 120 days. Since the pandemic is not going away anytime soon, associations should consider formally adopting COVID-19 Rules that will stay in effect until the pandemic is over or until the association decides to repeal the COVID-19 Rules at a duly noticed general session meeting of the board.

Emergency rules that were adopted over 120 days ago are no longer enforceable.

SwedelsonGottlieb can assist your association by (1) modifying your emergency rules into a standard rule that will stay in effect until the association decides to repeal the rule, (2) providing instructions on how to validly adopt the rule, and (3) creating a board resolution regarding the adoption of the standard rule for a flat fee of $350. SwedelsonGottlieb also offers the option to create new rules or make significant changes to the existing rules, which would be billed at our standard hourly rates.
