Maintenance Matrix

SwedelsonGottlieb often writes opinions for clients to advise them of the responsibilities for maintenance, repairs and replacement of building components where their association documents have conflicting information or confusing language.  One way to address significant issues that arise regarding provisions for maintenance and repair responsibilities is to amend the governing documents.  

 

Another effective tool to depict these responsibilities is a maintenance matrix. SwedelsonGottlieb reviews community association governing documents, including CC&Rs, condo plans, bylaws, and rules to prepare a maintenance matrix that assigns maintenance, repair, and replacement responsibilities to the association or owner in a simple, easy to understand chart form. 

 

The maintenance matrix should be referenced in the maintenance and repair provisions of the CC&Rs and can be included as an exhibit to the CC&Rs.
